A Las Vegas judge denied B.B. King‘s family’s bid to take control of the ailing musician’s affairs.

Three of his 11 surviving children had said they suspect King is being taken advantage of by his longtime business manager, Laverne Toney, who is in control of King’s affairs, the Associated Press reports.

They claimed Toney has been stealing money from King and neglecting his medical care. The 89-year-old singer was hospitalized last month due to dehydration from his Type II diabetes.

And last year, King canceled the remainder of his tour because of health problems.

But Clark County Family Court Hearing Master Jon Norheim said police and social-services investigations in October and April showed no evidence of wrongdoing on Toney’s part, according to the AP.

“There is no evidence of need for guardianship,” Norheim said. “Mr. King has counsel. I don’t have anything here that says he lacks capacity. He has some serious health issues. But he has counsel. If he feels like he’s being taken advantage of, he has remedies.”

For now at least, King’s affairs will remain in the hands of his longtime manager.
