New court documents from Rose’s legal team claim the unnamed plaintiff was not sexually assaulted

Chicago Bulls star Derrick Rose denied sexually assaulting a woman in court documents filed on Sept. 24.

An unnamed woman filed a civil suit against the point guard alleging that in August of 2013 Rose and two friends drugged her before gang raping her in her apartment. In the new court filing, Rose’s attorneys claim “the plaintiff consented to all sexual interaction and was not injured at all, and did not report, show or claim any injuries to anyone.” The document goes on to state that Jane Doe “exchanged friendly texts with one or more co-defendants after the day in question” but “became upset several weeks or months thereafter, when she felt that the Defendant was not responsive enough to her texts.”

A statement released by Rose’s lawyers in August said that the woman had participated in a “non-exclusive, consensual sexual relationship” with Rose for two years and called the allegations “outrageous” and “a desperate attempt to shake down” the former MVP.

Rose also denied the allegations during a Bulls press conference on Monday. “I will be proven innocent, but at the same time it hasn’t affected anything. It’s not true,” Rose said. “I take it as motivation. I feel like the devil is just working.”

Rose’s hearing is set for February 2017 in Los Angeles County Superior Court.

During practice on Tuesday, Derrick Rose suffered an orbital fracture after being hit in the face with an elbow. The Bulls said he needs surgery and don’t yet know when he will return. Rose has only played in 100 games since his 2010-2011 MVP season because of injuries to his back, ankle and knees among other issues.
