You Be The Judge!! Does He Have A Case of Discrimination?

Apparently idiocy exist everywhere including at Benjamin Moore Paints.  On this episode of Earhustle411’s “You Be The Judge” we are looking at a case where a former worker of the Benjamin Moore company is highly upset and is suing the company for discrimination. Subsequently the worker was terminated for reason unknown.

Clinton Tucker used to work for Benjamin Moore. Now, he is suing Benjamin Moore because Tucker, who identifies himself as an African-American, sees racism in the names of some of the company’s paints, which appear close to his own name. The offending paint names are “clinton brown” and “tucker chocolate.” Does he have a case?

According to our sister website, NJ.com, Tucker filed the lawsuit in Essex County court in Newark. According to court paper, he said he was hired in June 2011 in the digital marketing department but quickly found himself being discriminated against.

NJ.com reports that Tucker claims that while working on the online arm of Benjamin Moore’s campaign for their Williamsburg color collection, he learned of the new color “tucker chocolate,” which the suit called “extremely racially offensive.”

Tucker then learned of the existing color “Clinton Brown,” which a co-worker pointed out to him as a joke, the website says.

The paint company’s Williamsburg collection also has colors named tucker orange and tucker gray.

“Despite [Tucker’s] repeated complaints and protestations to BM management about these appallingly racial color names, no action was ever taken by Benjamin Moore to change the names of these colors,” according to the suit.

Tucker also claimed that he was demoted while white co-workers were given promotions, and that his request to take off work on Martin Luther King Jr. Day was ignored, NJ.com reported.

Tucker is seeking damages for discrimination, retaliation and a hostile work environment, according to the suit.

Benjamin Moore fired Tucker in March. The company isn’t commenting on the suit as yet.
