Sicko Creep Taking Upskirt Photos Of Women & Posting To Porn Site


WASHINGTON (WUSA9) — Beware, women, there’s apparently a creep filming up women’s skirts on the Metro and posting it to a porn website.

One such upskirt video was posted just 8 days ago to the XHamster website. Local blog PoPville broke this story first. The user in question is apparently posting videos of women, including female teens; one video is labeled “teen candid. ” The Metro map can be clearly seen in several of the videos.

Is this legal? In September, a D.C. Superior Court judge ruled it was not illegal for a Virginia man to take pictures up women’s skirts without their consent or knowledge at the Lincoln Memorial. Police say the man had multiple upskirt photos on his camera when he was arrested.

“Clearly it’s illegal conduct in Maryland and Virginia, in the District, it’s less clear whether it’s illegal or not, it has to do with a reasonable expectation of privacy. D.C.’s statute is not as restrictive and therefore it’s not as clear whether it’s prohibited conduct under the criminal code,” said Managing Attorney David Haynes of The Cochran Firm. In the videos, it’s not clear in which jurisdiction the filming took place.

Criminal or not, Metro calls it disturbing and Metro Transit Police are investigating.

“As always, we encourage riders to report any harassment or unusual behavior to Transit Police, even if the incident may not rise to the level of a crime. Reports can be submitted online, by phone (202-962-2121) or text message (MyMTPD).”

Attorney Haynes says even if it’s tough to prove this was a crime, victims could file a civil lawsuit for invasion of privacy. WUSA9 contacted the porn website. In its user agreement posted on the site, it states that when a user submits video, that user is affirming they have permission. The site did not write us back.

The videos appear to be taken with a smartphone and it seems the subjects are unaware the videos are being taken.
