“Real Housewives of New Jersey” star Joe Giudice is in deportation proceedings as he remains in federal prison on a 41-month sentence.

“Real Housewives of New Jersey” star Joe Giudice is in deportation proceedings as he remains in federal prison on a 41-month sentence.

A spokesman for the U.S. Immigration and Customs Enforcement confirmed to the Daily News that it has lodged a detainer and Giudice is in removal proceedings from the United States back to his native Italy.

His lawyer, however, denied that the deportation has been decided.

“I can state with absolute certainty that no decision has been made regarding the immigration status of Joe Giudice. The same immigration detainer that was lodged against him in March of 2016 remains in place today, but I want to be absolutely clear about this, no judicial authority has made any decision regarding what will happen with that detainer,” James Leonard Jr. said in a statement to People.

Mr. Giudice has immigration counsel who are and have been working aggressively on his behalf so that he can return home to his wife and four young daughters and we remain optimistic that that is how this will end.”

The reality star, whose wife Teresa found fame on the popular Bravo TV series, was transferred in November from the Federal Correctional Institution at Fort Dix, N.J., to a prison in Allenwood, Pa.

The move came because Giudice requested placement in a residential drug and alcohol abuse program, something Fort Dix denied him because an ICE detainer had been put in place.

Wife Teresa has floated the possibility of her husband’s deportation for years, and said on an episode of “Real Housewives of New Jersey” that she was open to following him back to Italy.

I mean, Italy’s a beautiful place to live. I wouldn’t mind, you know, I’m just saying,” she said. “Listen, whatever God has planned for me, that’s what’s going to happen. I will embrace it the best I can.”

Giudice, who shares four young daughters with his wife, was born in Italy and moved to the United States with his family as a child. Though he is a permanent resident, he never became a citizen.

Teresa served her own prison sentence in 2015, and was released several months early from a 15-month sentence.

Giudice’s attorney did not immediately respond to a request for comment.
